Texas Deferred Adjudication- Helpful or Shameful?

August 31st, 2008 · 5 Comments

Texas Deferred Adjudication seems like a great systemn especially if you have received a traffic ticket or been caught for some minor infraction of the law such as public nudity or playing around with an adult in public. What is stunning is that the Texas Deferred Adjudication is also available to a repeat sex offender including indecency with a child, sexual assault, or aggravated sexual assault.  Doesn’t this seem a bit extreme?  I know that court dockets are overtaxed but to allow a sexual predator to take advantage of deferred adjudication seems to be a bit lax.

The latest case to be shuffled aside instead of tried is Rev. James Virtue Robinson IV of Fort Worth, Texas. He has pleaded guilty for sexually assualting a teenager in his church.  He has been put on 10 years probation and must register as a sex offender and if he serves his probation without further trouble, the conviction will disappear from his record. The arrest will still be on his record.  Does this really do justice to anyone who abuses a child?  While I am the first to say that prison is not always the answer, I do not believe that anyone who abuses children should be left off with a slap on the wrist.  Maybe it is time for the Texas Legislature to take another look at the Deferred Adjudication and rewrite this law.
